Mediation can help parties in conflict settle their own differences. Mediation is an informal, voluntary process in which an impartial third party helps the contending parties exchange views and explore options for resolving the conflict. The goal of mediation is to help parties reach their own mutually acceptable settlement of issues in dispute. Often, parties can resolve their issues through mediation without the necessity of litigation. Any decision reached is through the efforts and agreement of the parties themselves. Often times, Courts dictate that mediation is mandatory before a case can go to trial.
Arbitration takes place when the parties agree to have their dispute decided by an impartial referee after a hearing is conducted. Often times contractual agreements require that the parties to an agreement settle disputes through arbitration.
